General Terms and Conditions of the Partnership Program

1. Introductory provisions

1.1. Subject and participants

1.1.1. These general terms and conditions (hereinafter "GTC") govern the rights and obligations of the Operator and Partner participating in the partnership program (hereinafter "Program") available at booqito.com/en/partners-program.

1.3. Partner

1.3.1. Partner: A natural or legal person who has properly registered for the Program and agreed to these GTC. (hereinafter "Partner")

1.4. Agreement to terms

1.4.1. By participating in the Program, the Partner agrees to these GTC in full and undertakes to comply with them.

2. Subject of the program

2.1. Mediation of business opportunities

2.1.1. The subject of the Program is the mediation of business opportunities (potential clients - providers of leisure activities) by the Partner to the Operator in exchange for commission.

2.2. Lead definition

2.2.1. Lead: A lead (business opportunity) is considered a legal or natural person who meets the following criteria:

• Is a provider of leisure activities.
• Was acquired by the Partner and transferred to the Operator through a unique partner code or link.
• Is not already in the Operator's client database and has not been contacted by the Operator in the last 6 months before the recommendation by the Partner.
• Successfully concludes a contract between the Operator and this lead.

3. Registration and agreement conclusion

3.1. Registration process

3.1.1. Registration for the Program takes place by filling out and submitting an online form on the Operator's website.

3.2. Participation conditions

3.2.1. A condition for participation in the Program is agreement to these GTC. At the moment of acceptance of the Partner's registration by the Operator, a cooperation agreement is created, which is governed by these GTC.

3.3. Data update obligation

3.3.1. The Partner declares that all data provided during registration is true, complete and current. In case of their change, the Partner is obliged to update them immediately.

4. Rights and obligations of the partner

4.1. Right to promotion

4.1.1. The Partner has the right to promote the Program and acquire leads for the Operator. For this purpose, the Operator will provide a unique partner code and/or link.

4.2. Honest conduct

4.2.1. The Partner undertakes to conduct its activities honestly and in accordance with the laws of the Czech Republic and these GTC.

4.3. Prohibition of unethical practices

4.3.1. The Partner must not use unethical, misleading, fraudulent or aggressive marketing methods in connection with the Program. It is prohibited to use spam, spread false information about the Operator or its services, or impersonate the Operator's representative.

4.4. Liability for damage

4.4.1. The Partner is liable for damage caused to the Operator or third parties by breach of its obligations.

5. Rights and obligations of the operator

5.1. Partner account

5.1.1. The Operator undertakes to provide the Partner with access to a partner account where they can track their leads and commission amounts.

5.2. Lead records

5.2.1. The Operator is obliged to maintain accurate records of all leads and conversions (concluded contracts) obtained through the Partner.

5.3. Commission payment

5.3.1. The Operator undertakes to pay the Partner commission for each conversion that is marked as approved, in accordance with the conditions in these GTC.

5.4. Right to refuse or terminate

5.4.1. The Operator reserves the right to refuse registration of the Partner, even without stating a reason. Furthermore, it reserves the right to immediately terminate cooperation with the Partner in case of serious breach of these GTC.

6. Commission and payment terms

6.1. Commission amount

6.1.1. The commission amount is determined based on the current offer published on the partnership program page.

6.2. Conditions for commission entitlement

6.2.1. Commission is due to the Partner only if the recommended lead:

• was identified as unique and was not registered by another method,
• successfully completed registration and became a paying client of the Operator,
• met other conditions stated on the program page.

6.3. Payment terms

6.3.1. Commission is paid monthly, by bank transfer to the Partner's account, no later than 30 days after the end of the calendar month.

6.4. Minimum amount

6.4.1. The minimum amount for payment is 500 CZK. If the Partner does not reach this amount, the amount is transferred to the next period.

6.5. Commission payment

6.5.1. Commission is considered paid at the moment of debiting the amount from the Operator's account.

7. Termination of cooperation

7.1. Agreement duration

7.1.1. The cooperation agreement concluded on the basis of these GTC is concluded for an indefinite period.

7.2. Termination by partner

7.2.1. The Partner may terminate cooperation at any time, by written notice sent to the Operator's email.

7.3. Termination by operator

7.3.1. The Operator may terminate cooperation with immediate effect if the Partner seriously breaches these GTC. If the Partner does not breach the GTC, the Operator may terminate cooperation with a notice period of 30 days.

7.4. Consequences of termination

7.4.1. Upon termination of cooperation, the right to commission from all future conversions expires. The right to already approved but not yet paid commissions remains valid.

8. Personal data protection

8.1. Data processing by operator

8.1.1. The Operator processes the Partner's personal data in accordance with applicable legal regulations, especially GDPR. Detailed information about personal data processing is available in the Operator's privacy policy on the website.

8.2. Partner obligations

8.2.1. The Partner undertakes to process personal data of potential leads and customers in accordance with applicable laws, especially GDPR.

9. Final provisions

9.1. Legal system

9.1.1. Relationships not regulated by these GTC are governed by applicable legal regulations of the Czech Republic, especially Act No. 89/2012 Coll., Civil Code, as amended.

9.2. Validity and effectiveness

9.2.1. These GTC become valid and effective on January 1, 2025 and are available on the Operator's website.

9.3. Changes to terms

9.3.1. The Operator reserves the right to unilaterally change these GTC. Partners will be informed about changes on the website and/or by email. If the Partner does not agree with the new terms, they have the right to terminate cooperation.
